The recently released Fair Terms Notice by the UK Gambling Commission (UKGC) regarding terms and conditions for customer withdrawals has caught the attention of many online gamblers.

Although withdrawing winnings should be a straightforward and swift process, many players have encountered delays or confiscation of funds they believe to be unfair. The UKGC has therefore sought to enforce fair withdrawal terms to ensure players aren’t being taken advantage of.

In this article, we’ll look at:

How withdrawals should work

There are three fundamental components to the online gambling experience – deposits, playing games and withdrawal.

The withdrawal process often seems to be overlooked by the industry. However, for players, it represents the final step of the experience. They’ve finished playing and are ready to claim any winnings – kind of what it’s all about, really.

In a perfect world, this process would be simple. Players should be able to request a withdrawal, have it processed quickly, and then receive their money within the timeframe outlined in the casino’s terms and conditions (T&Cs).

Considering the above, there are a few factors that need to be in place for the withdrawal process to work properly:

  • T&Cs must be easily accessible, understandable and provide clear information about what players should expect, including estimated processing times and any potential fees.
  • The casino must have efficient financial systems in place to handle user withdrawal requests without delays or other issues.
  • Verification processes must be in place to prevent fraud but should not be used as an excuse to delay legitimate withdrawal requests.
  • The casino’s customer support function should be available to help players with any issues or questions they may have about the withdrawal process. Customer service should be easily contactable and responsive.

Commonly reported issues

Unfortunately, we don’t live in an ideal world. This means many players have experienced problems with the withdrawal process over the years. Some of the most common complaints include:

Confiscated withdrawal

Over the years, many players have reported issues with casinos confiscating their funds. Unfortunately, sites have often justified this by referring to vague terms about “bonus abuse” or “irregular play”, which leaves players unable to retrieve their winnings and confused as to how or why this has happened.

Delayed withdrawal

Delayed withdrawal are one of the most common complaints reported by players and can be incredibly frustrating. These delays range from a few days to weeks and often far exceed the processing times outlined in the site’s T&Cs.

Verification barriers

Verification processes can be frustrating for players but they’re essential for ensuring security and preventing fraud. However, excessive or repeated verification requests have been known to unnecessarily delay withdrawal for players, even if they’ve been verified before. Players are often frustrated because they have provided what they understand to be everything that is required during the KYC (know your customer) process when they originally signed up.

Unclear terms and conditions

One of the most frustrating things when it comes to withdrawal issues is unclear or ambiguous T&Cs. Some players may find terms relating to wagering requirements or withdrawal limits are not clearly stated, which can lead to delays or confiscated funds.

Lack of customer support

To make matters worse regarding withdrawal issues, some sites don’t provide adequate customer support. This means players are left frustrated because they can't get to speak to someone who could provide them with assistance, a helpful response or resolution. That customer will feel aggrieved – regardless of whether they have deposited a lot or a little with that casino over a long or short time. And understandably so.

Furthermore, this is damaging to the overall industry. A poorly managed customer issue at one casino taints the industry as a whole.

UKGC Fair Terms Notice

Understandably, withdrawal issues have become a big problem for the UKGC. Chief executive Andrew Rhodes recently noted the UKGC Contact Centre received around 2,000 complaints each year relating to withdrawal delays. However, it’s worth considering this number is likely to be a drop in the ocean compared to how many users experience similar issues and don’t report them.

Interestingly, it seems the UKGC is taking this matter seriously, which will undoubtedly be welcome news to players. In a recent blog post by Rhodes, the UKGC sought to highlight the Fair Terms Notice it had issued to providers.

Some of the most notable additions to this notice include the following:

Communication

Players must be informed why a withdrawal has been delayed. Notably, casinos must not mislead customers in their communications with them. Any operator found to have done so will face regulatory action.

Fair terms

Sites must not rely on terms that give them undue discretion that could be unfair. For example, terms stating the operator “reserves the right” to void or withhold funds in certain circumstances, without outlining what those are, are prohibited.

Processing times

If an operator doesn’t have any regulatory concerns about a customer, there is no valid reason to delay withdrawal payouts. Any valid delays should be communicated to the player with a clear explanation. Verification procedures should also be completed during the deposit process, rather than at the time of withdrawal.

Unjust confiscations

Operators are prohibited from confiscating player funds without a valid reason. The UKGC outlines that customers must be allowed to withdraw their balance at any time without restriction, except to comply with regulatory requirements.

Expected outcomes

The implementation of the UKGC’s Fair Terms Notice is likely to lead to some changes in the way operators behave regarding the withdrawal process.

Potential positives

  • Improved customer experience: With transparency at the heart of the new terms, customers should be less likely to experience issues with unfair and vague terms, leading to an improved experience.
  • Increased trust: The enforcement of fair terms also means there’s likely to be an increase in trust between customers and sites.
  • Fewer delays: The most obvious positive should be reduced instances of delayed withdrawals. This is especially the case when it comes to unjust withdrawal postponement or confiscation of funds.

Potential challenges

  • Implementation struggles: Smaller operators may find it difficult to meet the demands of the Fair Terms Notice. For example, updating systems to comply with new requirements could be costly and lead to further friction with customers.
  • Enforcement issues: For the Fair Terms Notice to be effective, the UKGC will need to continually monitor all casinos and discipline those who break the rules. This could be a costly and time-consuming process.
  • Loopholes: Non-compliant operators may look to find loopholes in the new terms, which could lead to even further issues with withdrawal delays and funds confiscations.

Conclusion; what to do?

As outlined above, the UKGC is the first port-of-call for a player with a withdrawal complaint if it can’t be solved directly with the casino.

However, problems such as delayed withdrawal and confiscated funds can usually be avoided by steps a player can take much earlier in the process – by finding the right casino(s) to play at.
